INTRODUCTION.
IN 1872, the Register of Walter Gray, Archbishop of York, 1215-1255, appeared as one of the publica- tions of this Society, forming Volume LVI. of the series, under the editorship of the then Secretary, the late Canon Raine. Of the two succeeding archbishops, Sewall de Boville, 1256-1258, and Godfrey de Ludham, 1258-1264, no registers are extant, nor is there any trace that any ever existed. The Register of Walter Giffard, who was the next archbishop, and presided over the Northern Province from 1266 to 1279, is printed in this volume.
As Canon Raine in his Fasti Ebor accuses (i. 302- 3 1 7) has given a very full account of the life of this prelate, to which the editor of this volume can add little, and as Giffard had no special connection with the Northern Province previous to his translation to York, it will be more convenient, with a view to save room, to give merely a brief outline of the earlier portion of his career, and to devote the space thus gained to a study of the more important matters referred to in his register.
Walter Giffard was the son, probably the eldest son, of Hugh Giffard of Boyton, in Wiltshire, a man of rank and wealth, and Sibilla, daughter and coheiress of Walter de Cormeilles. Except that he

himself tells us that he was educated at Cambridge1 nothing is known about him previous to his elevation to the bishopric of Bath and Wells, to which he was elected on May 22nd, 1264. In the next year he was made Lord Chancellor of England, and, whilst holding that office, had a large share in promoting different remedial measures for the pacification of the country, which had fallen into a state of deplorable confusion after the death of Simon de Montfort. Many of the documents relating to these measures have been printed in the Letters from Northern Registers. His next promotion was to the primacy of the Northern Province. A considerable interval had elapsed since the death of Godfrey of Ludham, the previous archbishop, which occurred on Jan. i2th, 1264-5. John of Langton, or Rother- field, Dean of York, was elected on March i2th following, but his election was set aside by the pope, Clement iv., who by a bull2, dated Nov. 24th, 1265, nominated Boniface, the head of the Friars Minor, and afterwards known as the Seraphic Doctor. Boniface, however, refused to accept the dignity, and the pope promoted Walter Giffard by a papal provision, dated Oct. isth, 1266. He was enthroned on Nov. i st.3 and obtained restitution of the

temporalities on Dec. 26th following. He died on April 25th, 1279,' and was interred in the Minster, probably in the choir. His brother, Godfrey Giffard, bishop of Worcester, was his heir.2
His register comprises 146 folios of parchment ( 1 1 x 7), and six insertions, all written in a contem- porary hand. At the commencement is a brief index written on paper, compiled by the antiquary Torre, towards the close of the seventeenth century. To him also is due the pagination throughout. Till last year the register was encased in a slight parchment cover, but it is now substantially bound in half Morocco by Messrs. Eyre and Spottiswoode, bookbinders to the British Museum, and the manuscript has thus been rendered secure from injury. The volume is divided into two portions, the second commencing at p. 253. It had originally been used by Giffard as his register when bishop of Bath and Wells, and the portion relating to that diocese has been printed in Volume xiii. of the Somerset Record Series, which appeared in 1899. In editing this register it has been found convenient to give all formal documents, such as institutions, briefly in English. All other documents are given / in full, except those of a public character, which have been printed elsewhere, or those which relate to local affairs or persons, which have already

appeared in the publications of this Society. Numbers have been prefixed to the documents to facilitate reference.
This register, though much fuller than that of Archbishop Gray, is very far from perfect. The long periods of time for which there is no record show that a great deal must have been omitted. The earliest date is Jan. 24, 1266-7 (No. 283), and the earliest record of any official act performed within the diocese is dated at Cawood, on May 20, 1267 (No. 60), although the archbishop did not come permanently into residence until the autumn of that year. Up to the close of 1272 the entries are numerous enough to render it possible to compile a fairly complete itinerary of the archbishop during that period. He was often absent from his diocese, as for example from Dec. i, 1269, till Aug. 16 in the year following, besides other briefer periods, when he was engaged on public affairs. Although he seems to have resigned the office of Lord Chancellor when he was made archbishop, he still continued a member of the royal council, which necessitated his frequent presence in London and the South of England. In consequence of his holding this official position a number of documents of a more or less public character have been entered on the pages of his register. The more important of these have been printed by the late Canon Raine in Letters from Northern Registers, and the third volume of Historians of the Church of York, both of which appeared in the Rolls Series. death of Henry III., the archbishop acted as one of the regents of the kingdom till the return to England of his successor, Edward I., in August, 1274. This accounts for the fewness of the entries after 1272. It is interesting to note that Giffard was in London between Oct. 13, 1272 (No. 269), and the end of January following (Nos. 275, 40), probably awaiting the impending death of Henry III., which happened on Nov. 16, and afterwards taking part in providing for the quiet succession of Edward. From the last of these entries, with the exception of a single entry on July 25, 1273 (No. 41), when the archbishop was at Theyden (probably one of the places of that name in Essex), the register is silent concerning his movements till Sept. 23, 1274, when we find him again in his diocese at Scrooby (No. 863, p. 286). z Apart from his official duties in England, absence in foreign parts abroad kept him away from his diocese. On Feb. 28, 1274, he had letters of protection whilst beyond the seas (Calendar of Patent Rolls (1272-1281), p. 44) ; and an entry on the Close Rolls 2 shews that the object of his journey was to attend the Council of Lyons. This very important Council, known as the Fourteenth General Council, sat from May 7 to July 17 in 1274, and effected a temporary reconciliation between the Greek and Roman
to the Council of Lyons by the King's licence, has given power to John de Beninge worth to make attorneys in his place until the quinzaine of St. John the Baptist. Date not given, but apparently some time in 1273 (Calendar of Close Rolls (1272-1279), p. 113).

Churches. The archbishop also had letters of protection whilst he was abroad on Feb. 5, 1275 (Calendar of Patent Rolls (1272-1281), p. 78).
The state of confusion which prevailed in the kingdom at large is reflected in this register, for its arrangement is in many respects chaotic, falling far short of the systematic arrangement introduced by Archbishop Romanus (1285-1296). Many important portions of the diocese are entirely ignored. The first heading for the Archdeaconry of Richmond (p. 37), contains no entry relating thereto, and when it occurs the second time (p. 289), only a single entry. The information as to the Peculiars, such as Southwell, Ripon, Beverley, Hexham, and St. Oswald's, Gloucester, instead of being gathered together into separate sections, as is the case with later registers, is scattered through the volume, and is very meagre. Little is told about the dependent sees of Durham and Carlisle, and only place in the latter which is referred to is Caldbeck (No. 351).
The unsettled condition of the country is shewn also by the number of claimants of the same living. To the church of Adlingfleet, which had belonged to John de Eyvile, one of Simon de Montfort's adherents, there were five presentations or collations made by ten different persons, and for Stonegrave there were three applicants. The tribunal by means of which the archbishop made inquiry concerning the title of the patron and the fitness of the presentee was composed of members of the rural

deanery in which the church alleged to be vacant was situated, and good examples of such inquisitions are found in Nos. 125 and 170, taken on vacancies at Gargrave and Rillington. But this most interesting class of document occurs only in the first part of this volume. The presentee seems to have appeared in person at the inquisition, as in one case (No. 291) his age was judged from his personal appearance. Many of the presentees were in minor orders. In the case of a vacancy at West Retford (Nos. 298, 303), one of the presentees was an acolyte and the other had received only the first tonsure. In each case the patrons were of high rank, Sir Henry of Almaine, nephew of the King, and Prince Edward, afterwards King Edward I. The archbishop himself set a bad example, as he conferred the archdeaconry of York on his brother, Godfrey Giffard, afterwards Bishop of Worcester, while only in minor orders and in possession of many other benefices (p. 10). At Bossall it appears that William of Rotherfield, probably a relative of the Dean of York, though only in subdeacon's orders, was beneficed elsewhere (No. 164).
To obviate the scandal which would have arisen if persons not duly qualified were permitted to hold livings, it was the archbishop's custom to command the presentee to come to the next ordination, and in the meantime to commit the custody of the living to some suitable person nominated by himself. Cases of this kind occurred

at Linton, Bransby, and Treswell. At Skipton-in- Craven (No. 589) the archbishop refused to institute Stephen of Bradley, presented by the prior and convent of Bolton, on the ground that he was all but totally illiterate (fere totaliter illiterate*), and collated Nicholas of Fangfoss. By order of Cardinal Otto, who had been legate in England in 1237, all vicars were required to proceed to the priesthood within a year after their institution (No. 711). The archbishop strictly enforced this rule, and in one case (No. 711) he deprived an incumbent who failed to comply with it.
In addition to these matters the members of the inquisition were required to express their opinion as to the fitness of the presentee to perform the duties of the living to which he had been presented. Their reports were almost universally favourable,— " Quo ad mores, etatem, et scienciam laudabile perhibetur testimonium/' or " Est ydoneus, legitimus, et bone et honeste conversationis " is the usual form. The Nottinghamshire inquisitors were very cautious in some cases (Nos. 292, 294, 298) in expressing an opinion, and qualified what they had to say concerning the presentee's fitness by adding, " Quantum humana fragilitas scire permittit," thus admitting they might be mistaken. The value of the living and the different burdens to which it was subject were also duly ascertained.
Besides enforcing the rule that beneficed clergy should be ordained priests, the archbishop endeavoured as far as he could to put a stop to

plurality, which then and for long afterwards was a crying scandal. In a list of articles (No. 824), as to which certain commissaries were appointed to make inquiries, in 1275, the question of plurality occupied the first place, and in an earlier, but undated, mandate (No. 748), he directed that offenders in this matter should be cited before him, to produce their dispensations to hold more than one benefice if they had any. With Bogo de Clare, a son of the Earl of Gloucester and Hertford, and one of the most notorious pluralists of the age, the archbishop was unsuccessful in his attempts to eject him from some of his numerous livings, notably from Adlingfleet, which was still in Clare's possession in the time of Giffard's successor, William Wickwane. In one place (p. n) Clare is said to have been in possession of over thirty benefices, though he had no dispensation to hold them, and was totally unfitted to do so from defect in age, orders, and knowledge. Another high-born pluralist, William Percy, not content with holding many churches with cure of souls without any dispensation, lived like a soldier, ran after the Court in a shameless manner, and filled many offices forbidden by the Canon Law to clerks (No. 822). Master John Clarell, rector of Hooton Roberts (No. 133), is another instance of the extent of this evil. When he was already in possession of six churches and a prebend, he obtained a dispensation to hold an additional church with cure of souls.
Difficult as it was for the archbishop to cope with

pluralists of native birth, he found those of foreign origin quite invincible. Quartered on the diocese by the Pope himself, they were all furnished with dispensations, so that the archbishop could not eject them. The number of foreigners holding preferment in the diocese was very considerable. In his own cathedral five prebends were in their hands (Nos. 71, 143, 579, 902, and p. 94"), and two others were claimed by them (Nos. 636, 753), in addition to an annual pension of one hundred marks from the prebends of Warthill and Newbald, due to Cardinal Ottobonus (No. 24). An Italian held the important office of Archdeacon of Cleveland (No. 358) ; and the sacristan of the richly endowed chapel of St. Mary and the Angels, to which thirteen parish churches, distant and remote from one another, were annexed, was in the possession of another Italian, a brother of the legate Ottobonus (Nos. 579, 580). To keep in with the Roman Curia the archbishop had to pay from his own resources an annual pension of ten marks to the Archdeacon of Agde, in the South of France (No. 38). At Ripon (No. 579), one prebend was held by a foreigner, and at Southwell (No. 317), two of the prebends were subject to a charge of fifty marks a year in favour of the Pope's nephew, Adenulf, who later on (No. 356) was authorised by the Pope to receive the whole of the income arising from his benefices in this country, notwithstanding any custom or statute which provided that absentees should only receive half, or some fixed portion. It would be

interesting to find out how this disagreement between the Pope's licence and the law of the realm was settled. The churches of Skipwith, Fishlake, Felixkirk, and High Hoyland ' were all held by aliens (Nos. 357, 606, 649, 901).
Even with the officials of native birth the arch- bishop had some difficulty in maintaining friendly relations. His chancellor, William Wickwane, who afterwards succeeded him in the archbishopric, accused him of encroaching upon his rights and robbing him of certain fees pertaining to his office (No. 145). With the Archdeacon of Cleveland, who was a foreigner, as is mentioned above, it was not to be expected that his relations would be cordial. According to the archbishop's statement (No. 351), the archdeacon treated him very ungrate- fully. He had always been the archdeacon's friend, and he was astonished to find him accusing him to the Pope. Although this friction existed between them, the archbishop attached great weight to the archdeacon's opinion, and in one case, wrote a special letter to ask his advice on a matter of difficulty (No. 650). The most troublesome dignitary with whom Giffard had to deal was the Archdeacon of Nottingham, Thomas de Wyten, who had to be publicly admonished to be obedient (No. 43).
Money difficulties were amongst the most pressing of the troubles by which the archbishop was

harassed. Obtaining the pall from Rome must have been a very costly proceeding (No. 58oA), and, although the Pope, with the object of lightening the burden of debt on his church, allowed him to retain the first fruits of vacant livings, and a quarter of the fruits of the churches, dignities, and prebends in his collation (No. 45), money had more than once to be borrowed for the purpose of expediting his business at the Roman Curia (Nos. 36, 444, 629).
The archbishop found that borrowing money to pay the expenses of his proctors at the Court of Rome was like falling into a whirlpool of usury (usurarum vorago) (No. 444). He was weighed down not only by his own debts, but by those of his predecessor ; and when he was seeking the good offices of one of the cardinals, he made his poverty an excuse for the smallness of his gift, praying that regard should be paid rather to the good will of the sender than to the scantiness of the present (No. 575). As time went on his position grew worse. In the spring of 1270 all his means were exhausted, both his official income and that derived from his patrimonial estates, and he was so deeply in debt that it was impossible for him to visit the Apostolic See (No. 60 1). In three undated letters which occur in the register immediately after the one last mentioned, the same tale is repeated. Everything was against him. Things were going from bad to worse. Quarrels, fears of future disturbance, and the burden of

debt, brought him many sleepless nights. A couple of years later (No. 463) he was forced to plead for time in which to pay his debts, and suggested as a means to relieve the pressure, that some of them should be transferred to the dean and chapter. This continued lack of ready money necessitated frequent recourse to Italian merchants from Lucca, Siena, and Florence, the great money lenders of that age. In the summer of 1275, ne still owed 648^'. to some Lucca merchants (No. 853). This is the latest entry in the register relating to the subject of borrowing money, but it is very improbable that his financial embarrassments altogether ceased then. While the archbishop could fairly plead that his pecuniary troubles were due to debts incurred by his predecessors, hard times, and the exactions of the Curia, there were other causes contributing to his impoverishment, for which he was himself responsible. One of the chief of these was his liberality. To his own relations he was a most generous friend. He paid his mother's debts in 1268 (No. 397), made presents to Agatha Giffard (Nos. 458, 503), and gave 6oli. to J. Giffard (No. 458), probably a sister and brother. His other sisters were treated in an equally generous manner. Maude paid him a visit in 1268, which cost him 555. 5^. (No. 533). Alice de Mandeville, who seems to have been his favourite sister, constantly received pecuniary tokens of his love (Nos. 424, 503, 527, 531), besides a belt worth 405., and 335. ^d. for the expense of her journey from

Guilford to Churchdown (No. 458). His affection for her was so great that even her nurse shared in his largesse (No. 503). His nephews, Hugh de Babington and Robert de Escote, who was probably a son of Lady L. de Escote, to whom the archbishop made a present of iocs. (No. 458), were appointed to positions of trust about his person (Nos. 501, 850, 396). His method of providing for his brother Godfrey, by appointing him to the archdeaconry of Cleveland, has been already mentioned.1 The relative whose later career best justified the arch- bishop's generosity was William of Greenfield, who occupied the See of York, 1304-1315. Canon Raine in his Fasti Ebor accuses (p. 362) states that Greenfield was connected with the Giffard family, but does not give the exact relationship. The archbishop seems to have defrayed his expenses at Oxford, whither he had already gone in the summer of 1269 (No. 490), and where he still was in the November of the following year (No. 503). To enable his relative to maintain himself in a suitable manner he conferred on him a prebend in Southwell Minster, on Dec. 29, 1269 (No. 353), which he resigned for one in Ripon in 1272 (No. 259), This last he still possessed at the end of 1275 (No. 838), the latest mention of his name in this register. Another future archbishop, Master John le Romeyn, participated in his bounty, receiving a sum of i$li.

6s. Sd., part of a debt due to the archbishop at Paris, so that Romeyn may have taken his degree at that University (No. 503), a supposition which is rendered more likely by the fact that the arch- bishop paid i2d. to the beadle of the English Nation in that University (No. 458).
The same kindly spirit appears in a grant of considerable value, made to an old family servant (No. 560). It is true that this grant is crossed out ; but a gift of jli. 35. od. for silk and linen was probably made as a consolation (No. 503). Gifts to his chaplain, his washerwoman, and his barber were all prompted by the same kindly feeling (Nos. 396, 458, 503).
The archbishop's household expenses were very heavy. The separate items are not given, only the general term, household expenses, and it is possible that there are omissions. The following are sums total for three years, during which the accounts seem to be fairly complete : —

Even this large sum does not by any means represent the real cost the archbishop was put to for housekeeping. Most of the provisions would be furnished from his different estates, and so

would cost nothing in actual money. It is to be feared that this lavish expenditure must have greatly embarrassed the archbishop, who was already deeply indebted, not only on his own account for expenses incurred at his installation and at the Roman Curia for obtaining the pall and for other matters relating to the See, but also for obligations for which his predecessors had made him liable.
There is one very important class of documents in which the York registers are very rich, namely, the visitations by the archbishop of different religious houses in his diocese. In this register are recorded visitations by Giffard's predecessors, Walter Gray and Godfrey Ludham, of the Augustinian Priories of St. Oswald at . Gloucester, and Newburgh ; and by Giffard himself of Bolton, Felley, and Newburgh, all of the same Order, and also of the house of Cistercian Nuns at Swine. The great Benedictine house of St. German at Selby, after St. Mary's, York, the most important monastic settlement North of the Trent, reveals a very low state of morals (No. 919). The abbot, and more than one of the inmates, were strongly suspected of immorality. " Fetidissimus " is the adjective very aptly applied to Black Alexander, one of the monks. At the dependent cell of Snaith matters were little better. Of the clerks ministering in the church two were married. The parish priest, some sixteen years previously, had kept a concubine by whom he had had issue, but for some time past he had been of good behaviour. There were stories

about a monk from Selby, Thomas Gundale, but nothing was proved against him (No. 918).
In the smaller nunneries the chief trouble seems to have been financial, as the inmates were not competent to manage their property, which must have chiefly consisted of farms which they kept in hand. In four cases, Basedale, Hampole, Handale, and Nunkeeling, the archbishop was obliged to appoint guardians or stewards (yconomi\ generally monks from neighbouring monasteries, whose duty it was to bring the affairs of the house into good order.
The ordination list for Michaelmas, 1268, is the earliest existing. There is no record of another occurring before 1^42, when Zouche was archbishop.
There are sulphur casts of two seals of Archbishop Giffard in the British Museum. The first (LIX. 9) is from a chipped impression. Obverse — 2\ in. by \\ in. Pointed oval. The archbishop stands on a small bracket or corbel, full length, lifting up the right hand in benediction, in the left a pastoral staff. + WALTERVS DEI GRACIA EBORACEN' ECC'E MINISTER. The letters ' OR ' of ' Eboracen ' are conjoined. Reverse. — A counterseal. A smaller pointed oval, if in. by i in. The impression of an ancient gem, about f in. by \ in. Fortune draped, standing to the left, holding in the right hand a winged Victory, and in the left a shield, + AVE MARIA PLENA.
The other example (LIX. n) is a pointed oval (3^ by 2 in.). The archbishop on a finely carved Gothic

corbel, with embroidered vestments, full length, lifting up the right hand in benediction ; in the left hand a crozier. Overhead a small canopy of Gothic architecture, nearly entirely destroyed. Church vacant by the death of Mr. Hugh de Insula, a die Dominica prox. ante festum SS. Perpetuee et Felicitatis (March 4, 1267-8). Worth yearly 16 marks. The queen of England has no right to the presentation ; but it is disputed, as first Geoffrey de Neville presented John de Neville, then Sir Edward, Sir Laurence de Luversale, his elk., and afterwards the queen, Sir John de Sancta Maria, her chaplain and almoner.
